地下駐車場の管理業務は有害なの…?!
今日のお話は、弊所の顧問先でホテル業を営む会社の総務部長さんからのご質問です。総務部長「先日、当社が経営するホテルに労働基準監督署の立入り調査が入り、監督官から『地下駐車場で働くスタッフの時間外労働は１日２時間までとすること』という是正勧告を受けましたが…、正直、なぜ？ 地下駐車場の業務に関してはこのような制限があるのかが分かりません。その場では『ハイ、ハイッ！』と素直に返事をしましたが、どうも納得がいきません。土日などはお客様の出入りが多いため、３〜４時間くらいの残業は頻繁に発生しています…」「なお、当ホテルの駐車場は、地下と言っても換気は万全だし、明るく、常に清潔に保たれています…」
では、今日のお話し『地下駐車場で働く社員には２時間までしか残業をさせられないの…?!』についての社労士“Ｋ”の判断は続きを読んでくださいね…。
社労士“Ｋ”の判断
まず最初に、労働基準法第36条では、その但し書きにおいて「坑内労働その他健康上特に有害な業務については、時間外労働を１日２時間までとする」と定められています。
そして、この健康上特に有害な業務については、労働基準法施行規則第18条により10項目が定められており、さらに、具体的な業務としての行政解釈では「地下駐車場のうち、入庫受付業務、料金徴収業務、誘導等の場内業務、洗車等のサービス業務」は有害物の粉塵、蒸気等が発散する場所での作業であり、健康上特に有害な業務に該当するとされています（昭46.3.18基発233号）。
よって、御社の地下駐車場における業務は“時間外労働を１日２時間までとすること”という是正勧告が出されたのでしょう。
